A CURRY house owner dumped bags of rotting rubbish outside a rival takeaway to frame its owner.

Irshad Ali, who owns the Curry Cottage in Albert Road, Farnworth, Bolton, drove five miles in the early hours to target the Kurry Korner in Chorley Old Road. Bolton magistrates court heard that Ali, 44, dumped rotting carcasses, bin liners of leftover food, cooking oil drums and cardboard boxes around the takeaway's bins.

Residents blamed the Kurry Korner owner for the mess and business was affected. Environmental officers questioned the owner and finally caught out Ali after setting up secret surveillance cameras to monitor the takeaway. Images showed two men unloading bags of rubbish from a car in the early hours of March 24 and dumping them beside the takeaway. The bags contained letters and invoices that investigators traced back to Ali and the Curry Cottage.

Ali, a father-of-three of Gilbraltar Street, Deane, Bolton, pleaded guilty to three fly-tipping offences under the Environmental Protection Act. The court was told that rubbish from the takeaway was also found dumped in Deane Road and in Gilbraltar Street in April.

Mohamed Patel, defending, said a rubbish collection agreement drawn up with the council for Ali's business had expired. He said the Curry Cottage had now closed and Ali was working as a waiter at a restaurant in Eccles.
